These terms and conditions (the "Terms") govern your access to and use of tornasolyoga.com (the "Site") and every order placed through it. By accessing the Site or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Who we are

The Site is operated by Tornasol ("Tornasol", "we", "us"), an activewear business established in and operating from the Republic of Colombia. We design activewear produced in limited quantities by local artisans and offer it for sale worldwide. Contact: [email protected].

2. Eligibility

By using the Site you represent that you are at least 18 years old (or the age of legal majority where you live) and have the legal capacity to enter into a binding contract. If you place an order on behalf of another person or entity, you represent that you are authorized to bind them to these Terms.

3. Product imagery — AI disclosure

Tornasol is operated by two people. To present our products without a physical photography studio, images and videos on the Site, including product imagery, may be generated in whole or in part using artificial-intelligence tools. By using the Site you acknowledge and accept the following, which applies to all AI-generated or AI-assisted imagery:

(a) Images are illustrative only. Product imagery is a representation of the product, not a depiction of the physical item you will receive. The actual garment may vary from the imagery in color, tone, texture, print or seam placement, proportions, drape, and fit.

(b) AI output may contain errors. AI-generated imagery can include artifacts, inaccuracies, or elements that do not exist in the physical product, including backgrounds, accessories, or fabric renderings that differ from reality.

(c) No real persons. Human figures appearing in AI-generated imagery are synthetic and do not depict real individuals.

(d) The written description prevails. The written product description (materials, measurements, sizing, and care) is the sole authoritative description of the product. To the maximum extent permitted by applicable law, you agree not to base any claim solely on a discrepancy between AI-generated imagery and the physical product where the product conforms to its written description. Nothing in this section limits your rights under section 10 where a product is defective or materially non-conforming with its written description.

(e) Our vow. We use AI imagery out of necessity, not conviction. We believe artificial intelligence is one more tool in humanity's toolkit, it enhances our capabilities, but it does not and will not replace us. As Tornasol grows, we vow to replace AI with humans: real photographers, real models, real hands at every step. We vow to fix fashion by refusing and competing against fast fashion. We vow to support artisans. We vow to work toward one world, without borders, united, not divided. We vow to take care of Earth, the home of billions of humans. These vows are a statement of our values and aspirations; they describe the company we are building, and are not a contractual term or warranty on which an order may be conditioned.

4. Products, availability and order limits

Our products are produced in limited runs (typically no more than twelve pieces per line). All products are offered subject to availability, and availability displayed on the Site is indicative only. We reserve the right, at our reasonable discretion, to limit quantities per customer or per order, to discontinue any product at any time, and to decline or cancel orders that we reasonably believe are placed for resale, placed by automated means, fraudulent, or abusive. Where we cancel an order under this section, amounts already paid will be refunded in full.

5. Orders and formation of contract

The presentation of products on the Site is an invitation to make an offer, not a binding offer to sell. Your order constitutes an offer to purchase. A binding contract is formed only when we accept your order, which occurs at the earlier of our express confirmation of acceptance or dispatch of the goods; an automated acknowledgement of receipt of your order does not constitute acceptance. If we do not accept an order, for example because of a stock shortfall, suspected fraud, a pricing error (section 6), or inability to verify payment or delivery information, we will notify you and refund any amounts paid without undue delay.

6. Prices and pricing errors

Prices are displayed in the currency indicated on the Site and, unless stated otherwise at checkout, include our 1.5% contribution to permanent carbon removal. Prices may be changed at any time, but changes do not affect orders already accepted.

Currency and conversion. Prices on the Site are displayed in US dollars (USD) because it is the international reference currency. As we are a Colombian company, the amount actually charged is converted to Colombian pesos (COP) at the moment of purchase, using the official market exchange rate (Tasa Representativa del Mercado, TRM) for COP/USD in effect on that day. The final amount reflected on your statement may differ slightly from the displayed price due to the exchange rates, conversion spreads, and fees applied by banks, card networks, and payment systems, which are beyond our control; such differences do not constitute a pricing error and are not refundable by us.

Carbon-removal contribution. We are committed to, and do, contribute 1.5% of our revenue to permanent carbon removal through Frontier (frontierclimate.com). Our obligation is limited to making that contribution. We do not control, supervise, audit, or verify Frontier, its portfolio projects, or its use or allocation of funds; we rely in good faith on Frontier's own vetting, governance, and reporting. We make no representation or warranty as to the effectiveness or outcomes of any carbon-removal project, and we accept no liability for the acts or omissions of Frontier or the projects it funds. The contribution is our own commitment, priced into our products: it is not a donation made by you, confers no tax benefit on you, and creates no relationship between you and Frontier.

Despite our care, a price, description, or availability may be displayed in error. Where an error is obvious and could reasonably have been recognized as such, including a manifestly incorrect price, we may cancel the affected order before or, to the extent permitted by applicable law, after acceptance, and will refund all amounts paid. We are not obliged to fulfil an order at a manifestly erroneous price.

7. Payment

Payment is collected at the time of order through third-party payment service providers (currently MercadoPago; additional providers, such as Stripe, may be offered). Your payment credentials are transmitted directly to the provider; we do not receive or store full card numbers. You represent that you are authorized to use the payment method you provide.

We may withhold dispatch, or cancel an order and refund it, where a payment is flagged for fraud review, fails verification, or is reversed. If you initiate a chargeback on a legitimate, delivered order without first contacting us to resolve the issue, we reserve the right to dispute the chargeback, to recover the goods or their value, and to refuse future orders.

8. Taxes, imports and cross-border purchases

(a) Colombian seller. Tornasol is established in Colombia and is subject to the authority of the Colombian tax and regulatory bodies. We declare, report, and pay taxes on our sales exclusively to the Colombian authorities. We are not registered for, and do not collect or remit, sales tax, VAT, GST, or any equivalent consumption tax in any other jurisdiction.

(b) Place of sale. To the maximum extent permitted by applicable law, each sale is deemed concluded in the Republic of Colombia, and your purchase has the same legal character as the purchase of physical goods within Colombian territory, with international carriage arranged for your convenience.

(c) You are the importer. Where goods are delivered outside Colombia, you act as the importer of record. You are solely responsible for compliance with the laws of the destination country, including any import declaration, and for all import duties, customs fees, taxes, brokerage, storage, and any other costs levied on the order in that country ("Import Charges"). Import Charges are not included in our prices or shipping fees, are not collected by us, and are not refundable by us. Refusal to pay Import Charges resulting in the return, abandonment, or destruction of a shipment does not entitle you to a refund of shipping costs, and any refund of the product price may be reduced by the costs the refusal causes us.

(d) Restricted destinations. If the import of our goods is prohibited or restricted in your country, it is your responsibility to know this before ordering; we may cancel orders to destinations we cannot lawfully or practically serve.

9. Shipping and delivery

Shipping is governed by our shipping policy, which forms part of these Terms. In summary: we commit to a handling window (the time from order to hand-over to the carrier) per shipping method; we make no representation or warranty as to arrival dates once a shipment is with the carrier; and free worldwide shipping is achieved by grouping orders, which extends the handling window. Risk in the goods passes to you upon delivery to the address you provided. You are responsible for the accuracy of the delivery information you provide; costs arising from incorrect or incomplete addresses are yours.

10. Returns, non-conformity and statutory rights

(a) Change of mind. You may return an item within 14 calendar days of delivery, provided it is unworn, unwashed, undamaged, and has all tags attached. Contact [email protected] with your order number to initiate a return. Refunds are issued to the original payment method after we receive and inspect the item. Return shipping for change-of-mind returns is at your cost, and Import Charges are not refundable.

(b) Defects and non-conformity. If an item is defective in materials or workmanship, or materially fails to conform to its written description, we will, at your choice and at our cost, repair it, replace it where stock allows, or refund it. Minor variations between AI-generated imagery and the physical product (section 3) do not constitute a defect or non-conformity where the product conforms to its written description.

(c) Statutory rights. These Terms do not exclude, limit, or replace any warranty, guarantee, or remedy that applicable consumer law grants you and that cannot lawfully be excluded, including the legal guarantee under the Colombian Consumer Statute (Ley 1480 de 2011) and equivalent mandatory protections where you live. Where such law grants you longer or stronger rights than this section, that law prevails.

11. Intellectual property

The Site and all of its content, including the Tornasol name, wordmark, and logos, product designs, imagery, video, text, and software, are owned by Tornasol or its licensors and are protected by intellectual-property laws. Except for viewing the Site for personal, non-commercial use, no license or right is granted to you by implication or otherwise. You may not reproduce, modify, distribute, scrape, frame, or commercially exploit any part of the Site or its content without our prior written consent. Personal, non-commercial sharing of our content with attribution is permitted.

12. Acceptable use

You agree not to: (a) interfere with or disrupt the Site, its servers, or its security features; (b) access the Site by automated means or harvest data from it at scale; (c) use the Site for any unlawful purpose or in violation of these Terms; (d) place fraudulent orders or provide false information; or (e) attempt to gain unauthorized access to any account or system. We may suspend or terminate access, cancel orders, and refuse service where we reasonably suspect a breach of this section, without prejudice to our other rights and remedies.

13. Product use and assumption of risk

Our products are garments, not safety or medical equipment. Content on the Site relating to yoga, exercise, or wellbeing is general information, not medical or professional advice. Physical activity carries inherent risk; you are responsible for ensuring an activity is appropriate for you, and you engage in it at your own risk. Always follow the care instructions supplied with each garment; damage caused by misuse, incorrect care, or normal wear and tear is not a defect.

14. Disclaimer of warranties

The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, regarding the Site and its content — including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. This disclaimer applies to the Site and its content; it does not diminish the product guarantees described in section 10.

15. Limitation of liability

To the maximum extent permitted by applicable law: (a) our total aggregate liability arising out of or in connection with the Site or any order is limited to the amount you paid for the order giving rise to the claim; and (b) we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, even if advised of the possibility.

Nothing in these Terms excludes or limits liability for fraud or fraudulent misrepresentation, for death or personal injury caused by negligence, for gross negligence or willful misconduct, or for any liability that cannot be excluded or limited under applicable law, nor does it limit mandatory consumer rights.

16. Indemnification

You agree to indemnify and hold Tornasol harmless from reasonable losses, liabilities, damages, and costs (including reasonable legal fees) arising from a third-party claim caused by your breach of these Terms, your unlawful use of the Site, or false information you provide, except to the extent the loss results from our own fault. This section does not apply where and to the extent prohibited by applicable consumer law.

17. Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, war, civil unrest, labor disputes, carrier or customs disruptions, power or internet failures, and acts of government. If such an event delays an order materially, either party may cancel the affected order and we will refund amounts paid for undelivered goods.

18. Governing law and disputes

These Terms and any dispute arising out of or in connection with them are governed by the laws of the Republic of Colombia, and the courts of Colombia have jurisdiction, provided that, if you are a consumer, you retain the protection of the mandatory consumer laws of your country of habitual residence and any right to bring or defend proceedings in its courts.

Before initiating any formal proceeding, you agree to first contact us at [email protected] and allow us 30 days to attempt to resolve the matter in good faith.

19. General provisions

Entire agreement. These Terms, together with the policies they incorporate (shipping, privacy), are the entire agreement between you and us regarding the Site and supersede prior understandings on that subject. Severability. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remainder will remain in full effect. No waiver. Our failure to enforce a provision is not a waiver of it. Assignment. You may not assign these Terms; we may assign them in connection with a transfer of the business, without reducing your rights. Survival. Sections that by their nature should survive (including 3, 8, 11, and 14–18) survive termination. Electronic communications. You consent to receive contractual communications (order confirmations, notices) electronically at the email you provide. Language. Where these Terms are translated, the English version governs to the extent permitted by applicable law.

20. Changes to these terms

We may amend these Terms from time to time. The version in force when you place an order governs that order. The date above indicates the current version; material changes will be announced on the Site.
